Bonds no se salvaría de cargos

SAN FRANCISCO (AP) - Barry Bonds tiene pocas probabilidades de lograr la anulación de su proceso por perjurio.

Los abogados de Bonds proyectan pedir el viernes a la juez federal de distrito Susan Illston que desestime la querella federal que lo acusa de haber incurrido en perjurio y obstrucción de la justicia durante su testimonio ante un jurado investigador, en el cual negó que hubiera utilizado conscientemente sustancias prohibidas para mejorar su rendimiento físico.

Bonds alega que los fiscales actuaron ilícitamente al hacerle preguntas confusas, vagas y ambiguas cuando se presentó ante el jurado investigador en diciembre del 2003. El ex astro de los Gigantes de San Francisco se ha declarado inocente. En documentos judiciales no admite ni niega haber consumido ese tipo de sustancias.

En caso de que la juez se niegue a desestimar los cargos, Bonds quiere que los fiscales simplifiquen la acusación, la cual cita 19 situaciones diferentes de las supuestas mentiras de Bonds pero solamente lo acusa de cuatro cargos de perjurio y uno de obstrucción de la justicia.

En sus documentos, Bonds impugna en detalle cada una de las pruebas y se queja de que cada cargo debería citar sólo una de las situaciones en que habría mentido.

El profesor de derecho Rory Little de la Universidad de California en San Francisco calificó de inteligente la táctica de Bonds, aunque al igual que otros especialistas estimó muy improbable que el rey jonronero en las Grandes Ligas consiga la desestimación del caso.

Little dijo que los fiscales tratarían de interponer una versión actualizada de la acusación si la juez llegara a apoyar los argumentos de Bonds incluso parcialmente. Es común que los fiscales presenten nuevas acusaciones formales para aclarar cargos, pero sin alterar los señalamientos centrales, de acuerdo con Little.
